Who We Are
Blast’d is a content publishing system that allows users to post text, video, pictures, music, and other forms of information to the web. Users may do so as individuals or in groups. Content is published to a user’s "show," and on their personal profile. In unique circumstances, Blast’d will republish certain content on other parts of the site, and we reserve the right to do so.
Who Can Use Blast’d
The use of Blast’d is available to all persons age 13 and over who agree by these terms of service. By using Blast’d, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of Blast’d does not violate any applicable law or regulation. This Terms of Use Agreement sets forth the legally binding terms for your use of the Blast’d Services. By using the Blast’d Services, you agree to be bound by this Agreement, whether you are a "Visitor" or you are a "Member" (which means that you have registered with Blast’d). The term "User" refers to a Visitor or a Member. You are only authorized to use the Blast’d Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and the terms of this Agreement. If you do not agree to be bound by this Agreement and to follow all applicable laws, you should leave the Blast’d Website and discontinue use of the Blast’d Services immediately. If you wish to become a Member, communicate with other Members and/or make use of the Blast’d Services, you must read this Agreement and indicate your acceptance during the registration process.
Allowable Content and Use
Users of Blast’d are encouraged to publish their content however they feel fit. BUT, we have certain rules over which content is NOT allowed the site. The following content is NOT allowed and users accounts will be deleted if we feel these rules have been broken. The following content is NOT allowed:
• Unlawful, harmful, or obscene content.
• Publish content you do not have the right to transmit.
• Publish content that infringes on trademarks or copyrights.
• Publish or install malicious scripts
• Crawl content without permission from Blast’d.
Blast’d may reject, refuse to post or delete any content for any or no reason
Rights Reserved
Blast’d reserves the right to filter any content posted and remove objectionable posts without notice. Blast’d may also cancel accounts for users who violate the Terms of Service.
Blast’d respects your copyright. You retain full copyright of any original content that you send us. By posting to Blast’d, you're granting us a license to distribute your content on this site. Blast’d does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials that you post on the Blast’d website. After posting your Content to Blast’d, you continue to retain any such rights that you may have in your Content, subject to the limited license herein. By displaying or publishing any Content on Blast’d, you hereby grant Blast’d a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Content. This limited license does not grant Blast’d the right to sell or otherwise distribute your Content outside of the Blast’d website.
To protect your privacy and security, we will take reasonable steps to verify your identity before granting access or making corrections. The main form of identity management is your e-mail address. Please always use a valid and up-to-date e-mail address.
Limitation On Liability. IN NO EVENT SHALL BLASTD BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE MYSPACE SERVICES, EVEN IF MYSPACE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, BLASTD'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO BLASTD FOR THE BLASTD SERVICES DURING THE TERM OF MEMBERSHIP.
Disputes. The Agreement shall be governed by, and construed in accordance with, the laws of the State of California, without regard to its conflict of law provisions. You and Blast’d agree to submit to the exclusive jurisdiction of the courts located within the State of California to resolve any dispute arising out of the Agreement or the Blast’d Services. EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION (INCLUDING BUT NOT LIMITED TO ANY CLAIMS, COUNTERCLAIMS, CROSS-CLAIMS, OR THIRD PARTY CLAIMS) ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS AGREEMENT. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS AGREEMENT.
Blast’d may modify this Agreement from time to time and such modification shall be effective upon posting by Blast’d on the Blast’d Website. Your continued use of the Blast’d Services after Blast’d posts a revised Agreement signifies your acceptance of the revised Agreement. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.
